Megadeth Investigating Plagiarism Claims After Christmas Card Contest

The winner of the Megadeth Christmas card contest may have cheated. The band received a tip from a fan that the winning artwork was stolen, and now Megadeth is investigating the plagiarism claim.

According to MSN, Megadeth asked fans to submit original illustrations for a Megadeth holiday card. The top 10 winners all got a prize and the Grand Prize winner received a call from Dave Mustaine on Christmas Day.

Mustaine already called the winner but Megadeth said that it was still investigating the plagiarism claim.

Megadeth writes on its website:

“This year, our winner Jim Chadoulas allegedly submitted the artwork of another artist. Although we were notified of the possible plagiarism by an anonymous fan in Brazil after the Christmas Day call was already placed, we are investigating this matter further. We stand by the fact that Jim is innocent until proven guilty, and if our winner did indeed use someone else’s artwork, we will be notifying the second place winner to award him the first place prize and he will receive a phone call from Dave Mustaine. We hope to clear this up as quick as possible.”

    Brian Saunders First of all it is spelled Ole, and you always capitalize the start of a sentance. Second, if you could read above a third grade level you would see that Dave Mustaine isn't crying about anything.     Megadeth rips stuff off all the time…Mechanix…Although, yes, I realize those were the original lyrics for that song on the Metallica demo No Life Til Leather, and new lyrics came about in the recording of Kill Em All, or something along those lines…lol…

  24. If there is a contractual obligation that the work be original as stipulated in the contest rules, then it is plagiarism. For 1st Amendment parody protection, the source has to be seen as worthy of copying. SNL can parody the President, Twilight and Kim Kardashian all they want because those are well-known precedents. In a very relevant case, a Jeff Koons sculpture – copied from a photographic image on a postcard with slight changes – was denied the parody protection that he claimed because very few people would know the original work and why it was being parodied. In other words, parody has to have a need, and the artistic connection between source and copy has to be acknowledged by both the parody's artist and audience. Otheriwse it is theft.
